Please read the following AGREEMENT OF RELEASE and WAIVER OF LIABILITY carefully before agreeing and signing:
1. AGREEMENT OF RELEASE AND WAIVER OF LIABILITY
(a) I voluntarily participate in the Yoga Retreat offered by Bonfire Hot Yoga LLC, Seth Brown, Emily Cawley Feldman,, Krystal Conniry, and its staff (hereafter referred to as “the Facilitators”) during which I will receive information and instruction about yoga and health. I understand and acknowledge the fact that in yoga, as in other forms of exercise, sports, bodywork, or self-development, there exist certain inherent risks. I agree to assume full responsibility for all risks, injuries, loss or damages, known or unknown, which I might incur as a result of participating in the yoga program or other programs provided by the Facilitators.
(b) In further consideration of being permitted to participate in the Yoga Retreat, I knowingly, voluntarily and expressly waive any claim I may have against any of the Facilitators for injury or property damages that I may sustain as a result of participating in the Yoga Retreat including any and all activities done with the Yoga Retreat as a group or as an individual within or outside of the Casa Isabel grounds. I, my heirs and legal representatives forever release, waive, discharge and covenant not to sue any of the Facilitators for any injury, damage, or death caused by their negligence or otherwise.
(c) I understand that it is my responsibility to consult with my health care practitioner prior to and regarding my participation in exercise classes (including yoga), hikes, excursions, or other programs offered by the Facilitators. I am physically and psychologically fit and able to participate in the Yoga Retreat.
(d) I understand that if I am pregnant, I will take necessary steps to ensure my doctor and health care providers know I am participating in this Yoga Retreat. I assert that I am of fit health to participate in the Yoga Retreat and will alert all Instructors at the Yoga Retreat whose sessions I participate in that I am pregnant.
(e) The Facilitators do not accept any liability for cancellations, delays or changes caused by war, threat of war, terrorist actions or threats, closure of airports, civil strife, industrial action, natural disaster, technical problems to transport, staff cancellations, unforeseen changes in your personal circumstances or other events beyond their control.
2. CANCELLATION POLICY
(a) I understand that $500 of the registration fee is non-refundable. Further, should participant cancellation occur within 30 days of the event for any reason, I forfeit all fees. Should participant cancellation occur within 60 days of the event for whatever reason, only 50% of the total fee is refundable, less the $500 registration fee. Should the event be canceled by Bonfire Hot Yoga LLC, all fees will be refunded back to participant.
(b) Bookings are for the stated period of the retreat, January 5th 2023 through January 11th, 2023. There are no refunds for an unused portion of the retreat. If the reason for cancellation is covered under the terms of your Travel Insurance Policy, you may be able to make a claim on your insurance.
3. TRAVEL
(a) Travel insurance is required for all participants. It should cover the activity of this retreat as well as unexpected cancellation, sickness, losses and all the usual risks. You should bring the policy with you in case of an emergency.
(b) All travel arrangements for dates before and after the Yoga Retreat are your responsibility and at your own cost. The Facilitators shall not be held liable for any consequences arising from delays or cancellations in any of the companies you may have made arrangements with, or for any irregularities in your documentation required for travel. All events undertaken before and after the Yoga Retreat are at your own cost and risk.
4. AMENDMENTS
(a) Occasionally, changes may have to be made to the program (e.g. yoga teacher, class times or other arrangements), which we reserve the right to do at any time. If your accommodation has to be changed, we will do our utmost to provide accommodation of a similar rating. If a significant change becomes necessary, we will inform you as soon as reasonably possible if there is time before your departure.
(b) If you have a problem during your retreat, please inform the Facilitators immediately and he/she will endeavor to put things right. Please note that we cannot be responsible for the individual behavior of any group member or other guest sharing your accommodation.
5. PHOTOGRAPHY
(a) I, for good and valuable consideration, the receipt of which is hereby acknowledged, hereby irrevocably authorize Bonfire Hot Yoga LLC to use photographs of me and or my property and authorize it and its assignees, licensees, legal representatives and transferees to use and publish (with or without my name) photographs, pictures, portraits or images in any and all forms and media and in all manners including composite images or distorted representations, and the purposes of publicity, illustration, commercial art, advertising, publishing (including publishing in electronic form on CDs or internet websites), for any product or services, or other lawful uses as may be determined by the Facilitators. I further waive any and all rights to review or approve any uses of the images, any written copy or finished product.
I am of legal age and I have read the above release and waiver of liability and fully understand its contents. I voluntarily agree and confirm being invited to consult legal counsel before signing. By writing in my full name below, I hereby sign with my legally binding signature.
